Jailbreaking is not illegal, nor is it Warez, I'm not sure what programs are ready for the 4.3 jailbreak, if it's available yet, afaik iOS 4.3 is only in beta phases at the moment, I recommend using iOS 4.1 if you want a 4.x jailbreak, 4.2 is buggy.
